TERMS OF SERVICE

TERMS OF SERVICE GENERAL RIGHTS AND RESPONSIBILITIES:  This website, www.fingerprint-farms.com, (the “Website”) is published and maintained by Fingerprint Farms, LLC (the “Company”). The Company publishes and maintains the Website, including all information, tools and services included in, listed on, linked to, derived from, or accessed by you from Website by you, the user, upon the condition that you accept all the terms, conditions, policies, and notices contained therein. Usage of the terms “we”, “us”, and “our” contained in this document refer to the Company. 


When you visit the Website and/or purchase something from the Company you engage in the service provided by the Company (the “Service” or “Services”) and by so doing, agree to be bound by the terms and conditions set forth in herein (the “Terms of Service”), including any additional terms and conditions and policies referenced in the Terms of Service and/or available by hyperlinks within the Website. The Terms of Service apply to all persons or entities using the Website, including browsers, vendors, customers, merchants, and/or content contributors. 


By agreeing to the Terms of Service, you represent you are 18 years of age or older and that you consent to give the Company permission to allow any of your minor dependents to use the Website and Services provided therein by the Company.


You further agree that you may not use the Services, or any products procured from the Company for illegal or unauthorized purposes and that you shall not use the Services provided by the Company in violation of any law, including but not limited to copyright laws.


Further, the Company prohibits, and you agree to never transmit any worm, virus or any code of a destructive nature when accessing or using the Website or Services provided by the Company.


TERMINATION OF SERVICES:  Failing to comply with the Terms of Service or any breach thereof shall result in the immediate termination of Services you were entitled to prior to or after your failure to comply or breach of the Terms of Service. In addition, the Company reserves the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation when the Company believes that your conduct violates applicable law or is harmful to the interests of the Company.


TERMS OF SERVICE BINDING UPON ACCESS OR USE:  You are encouraged to read and understand the Terms of Service before using or accessing any portion of the Website. By using or accessing any portion of the Website, you agree to be bound by the Terms of Service. If you do not agree to be bound by the Terms of Service, then you shall not access the Website or use any Service offered by the Company. Should the Terms of Service be considered an offer, your acceptance is expressly limited to the Terms of Service. 


UPDATED TERMS OF SERVICE BINDING UPON UPDATE, ACCESS, OR CONTINUED USE:  The Company reserves the right to update, change or replace part of parts of the Terms of Service by posting updates and/or changes to the Website. In addition, any new features, tools, functions, or links added to the Website shall be subject to the Terms of Service controlling your use of the Website. You have the responsibility to periodically check the Terms of Service controlling your use of the Website and your continued use or access of the Website shall constitute your agreement to the then prevailing Terms of Service controlling the use of Services provided by the Company. 

 

PURCHASE PROCESS:  The weights of the products offered for sale by the Company on the Website vary between packages. As such, the Company’s objective in filling your order is to provide at least the size and number of cuts specified in your order (typically, the weight of the order delivered to you will be in excess of the minimum weights ordered). In order to meet this objective, it may be necessary, from time to time, for the Company to add additional cut(s) of beef or chicken to meet the minimum weight requirements of your order. Therefore, when you purchase a bundle of beef or chicken online from the Website, Company will ship at least the minimum number of cuts and total weight of beef or chicken as part of the bundle(s) you purchased. Based on inventory availability, Company shall have the right to ship an additional cut of beef or chicken in a bundle to meat minimum weight requirements for each product included in the bundle purchased. In addition, when you place a custom order online from the Website, Company will review its product inventory and determine if it has individual cuts of beef or chicken that are at least 90% of the weight of the products you ordered. If Company determines that an individual cut of at least 90% of the minimum weight is available, Company shall have the right to add and additional cut of beef or chicken to meet the minimum weight requirements of your order.  If a 90% cut is unavailable, Company will contact you to determine how the order can be adjusted to meet your needs, and a refund issued if Company does not have cuts in inventory to satisfy your needs. 


SHIPPING AND DELIVERY:  To reduce shipping materials and limit the ecosystem impact associated with selling its perishable frozen beef and chicken products (the “Perishable Products”) direct to you, the consumer: the Company intentionally limits and restricts the geographic area to which the Company will ship and/or deliver Perishable Products to addresses located within the following Texas counties, Tarrant, Dallas, Johnson, Ellis, Wise, Parker, and Hood; and at the sole discretion of the Company, either delivers shipments to shipper’s distribution centers in the DFW Metroplex twice a week, on Mondays and Thursdays, or makes deliveries directly to you on Mondays and Thursdays. 


When you complete a purchase from the Website on a Monday, Tuesday or Wednesday, the order will be shipped on the following Thursday, and when you complete a purchase from the Website on a Thursday, Friday, Saturday, or Sunday the order will be shipped on the following Monday(the “Designated Shipping Day”).  If a Designated Shipping Day falls on a Monday that is a holiday, products normally scheduled for shipment on that day will ship on the Thursday day immediately following the Designated Shipping Day. If a Designated Shipping Day falls on a Thursday that is a holiday, products normally scheduled for shipment on that day will ship on the Monday immediately following the Designated Shipping Day. To accommodate your ability to receive delivery of your order, you may choose a shipping date on a Monday or Thursday later than the Designated Shipping Date at the time you place your order. Otherwise, your order will be shipped on the Monday or Thursday immediately following the date your purchase is completed..


Shipping and delivery fees shall be charged as follows: (1) orders less than $100.00 will incur a shipping fee of $15.00; (2) orders less than $200.00 but greater than $100.00 will incur a shipping fee of $7.50; and (3) orders in excess of $200.00 will be shipped to you for free.


Except for purchases being picked up by you at the Company’s brick and mortar store located at 2849 S. Highway 171, Cleburne, TX 76031 (the “Physical Store”), before completing any order on the Website requiring shipping, you hereby agree to provide a valid, accessible physical delivery address located within the geographic area served by the Company (the “Shipping Address”).  Any designated Shipping Address provided to Company by you shall be suitable for the package to be left with no signature. Because Perishable Products are being shipped to you and to prevent delays in delivery, you agree and acknowledge that all orders are shipped with a “Shipper release” – meaning the either the Company or shipper is authorized to LEAVE the package at the designated shipping address without a signature. If the Company elects to deliver your product directly to you, the Company will send an email to you at the time your product leaves the Company’s facility, notifying you that the product is being delivered by the Company. Upon delivery of your product to you or your agent’s possession, delivery is complete. If the Company leaves the package at the designated shipping address without a signature, the Company will send you an email notifying you of the time that your product was delivered.Upon sending the email notifying you that your product has been dropped off at the Shipping Address, delivery is complete. If a shipper is used to ship your product to you, the shippers used by Company to ship the packaged Perishable Products to you will provide a tracking link to Company and the Company will send an email to you, at the email address provided by you when you ordered, notifying you that the package is in transit and providing you with the ability to track the delivery’s progress (the “Shipping Notification”). You further acknowledge and agree that the Perishable Products are packaged so that they will remain fresh for at least 24 hours from the time the package is delivered to the shipper’s distribution center or dropped at the Shipping Address by the Company, and that all packages dropped at the Shipping Address must be picked up either: within 24 hours of the time that the Shipping Notification is sent to you by the Company informing you that your product has been shipped; or within 24 hours of the time that the Company emails you that your product has been left at the Shipping Address by the Company.   


All Perishable Products are shipped frozen. Company agrees to package Perishable Products inside cardboard boxes with insulated liners and cool packs designed to maintain the freshness of the Perishable Products for at least 24 hours. To provide adequate time for delivery and pickup of packages, Company further agrees to maintain the packaged Perishable Product frozen in a freezer until such time as it is dropped off at the designated shipper’s distribution center. To ensure the packaged Perishable Products reach you in a fresh condition, Company agrees to only ship by overnight delivery service. 


FRESHNESS AND HANDLING:  Company guarantees that the Perishable Products delivered or shipped to you will be delivered to the Shipping Address in a fresh condition, typically frozen, but depending on the time of the year and the time you pick the Perishable Products up, there may be some thawing. (NOTE: If a shipment or product pick up is delayed and the Perishable Products have thawed, you should check the temperature of the Perishable Products to ensure that the temperature is below 45 degrees Fahrenheit. Perishable Products are considered fresh if they are below 45 degrees Fahrenheit.  If temperatures of Perishable Products are allowed to rise above 45 degrees Fahrenheit before delivery or pick up, they should not be considered fresh. To check the temperature, place a digital meat cooking thermometer in between two meat packages and press the packages together.  If the Perishable Product is above 45 Degrees Fahrenheit, take a photo of the thermometer when the temperature is taken and immediately email it to the Company). Upon pick-up or receipt of Perishable Products in fresh condition, you should always immediately unpack your order and place the Perishable Products in a freezer or finish thawing them for preparation. 

 

RETURN AND REFUND POLICY: 

Returns Prohibited:  Perishable Products may not be returned because they cannot be restocked or resold.

 

Perishable Products Not Delivered In Fresh Condition: To ensure your ability to receive a refund for Perishable Products that are not delivered in a fresh condition, you should immediately check the temperature of the Perishable Products, note the temperature and take a photo of the thermometer as the temperature is being taken, and immediately notify the Company of the condition by sending the photo to the Company by email at shop@fingerprint-farms.com. The time stamp on the email is critical to establishing proof that you picked up the Perishable Products in a timely manner. If you fail to follow these procedures, a refund of your purchase price will not be made by the Company. 


The Company cannot guarantee the condition of Perishable Products if the Shipping Address is incorrectly entered at the time of purchase. When placing your orders, care should be taken to ensure that the Shipping Address is accurate. If an order is returned to the Company because of an incorrect Shipping Address, the Perishable Products must be disposed of and you will not be entitled to any refund or other credits. 

If Perishable Products are delivered late because of an incorrect Shipping Address or are not picked up in a timely manner, you will not be entitled to any refund or other credit.


If a delay occurs because of other issues arising while Perishable Products are being delivered by the shipper (weather, accidents, etc.), or damage occurs due to improper handling, the Company will file a claim with the shipper and replace the order, if you notify the Company of the event within 7 days of receiving the order or of the expected delivery date. You should provide pictures of any damages to show proof of any damages. 


Other Unsatisfactory Conditions:  If for any reason you are not fully satisfied with your purchase, you should take photos of the product label and any damage to the product and contact the Company within 7 days of receipt. The Company will review your order and any reported issues and offer an appropriate solution, which may include replacement of the product in question, credit towards another order, or a partial or full refund. 


PRIVACY POLICY:  To use our Services, you may be asked to voluntarily submit personal information such as names, addresses, email addresses, phone numbers, and information required to make electronic payments for purchases (“Personal Information”). Unless other uses of Personal Information are expressly authorized by you, Personal Information will only be used by the Company to fulfill your specific requests. 

Personal Information may be shared with governmental agencies or other companies assisting us in fraud prevention or investigation. The Company may only do so when: (1) permitted by law; (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or(3) investigating fraud that has already occurred. 


Personal Information is not provided to any other person, company, agency, or government for marketing purposes. 


Personal Information is kept secure by the Company. Access to Personal Information is only granted to authorized employees, agents or contractors of the Company that have agreed to keep Personal Information received by them secure and confidential. 


If you grant the Company permission to use specific personal information to contact you or provide you information by email, text, newsletters, etc., you may opt out of further contacts at any time by notifying the Company of your decision by email at shop@fingerprint-farms.com


COPYRIGHT AND TRADEMARKS:  The Company protects all photos, text, names and trademarks presented or embedded in the Website (the “Protected Information”) and reserves all rights associated therewith to the Company and its owners. The Company grants you the right use the Protected Information solely to browse, shop and place orders on the Website, and any other use, reproduction, modification, distribution or republication is prohibited without prior, express written consent from the Company.
